Article 8 of Directive 2006/115/EC must be interpreted as precluding a Member
State from excluding performers who are non-EU nationals from the right to
single equitable remuneration, also in light of the relevant international
treaties (WPPT and Rome Convention).
A national legislation providing for a right
to a single equitable remuneration limited to producers of phonograms is not
consistent with EU law: performer who has contributed to that phonogram is
always entitled to remuneration.
