SKY,
one of the world’s biggest media company, challenges SIAE, the Italian
copyright collecting society, for abuse of dominance in the market of collection
of fair compensation due on films (art. 46bis of Italian
Copyright Act), against antitrust law.
The
Civil Court of Milan rules not only that no legal reserve is granted to SIAE in
respect of collection of fair compensation and thus free competition must be
respected in favour of all the collecting societies, but also that SIAE’s
behaviour amounts to an abuse of dominance forbidden by antitrust law.
